These Community and Content Guidelines (the "Guidelines") describe how people treat each other on Dude Where’s My Pro and what may be written and posted on it. They are part of the Customer Terms of Service and the Provider Agreement, under which Modest Services LLC, doing business as Dude Where’s My Pro ("we," "us," or "our"), operates the Dude Where’s My Pro app and website (the "Platform"). By using the Platform you agree to follow them. Where these Guidelines and your Terms or Agreement differ, the Terms or Agreement control.
SECTION 1. WHERE THESE GUIDELINES APPLY
1.1 Everything you write or post.
These Guidelines apply to everything you put on the Platform for someone else to read or see: requests for work, bids, messages, changes of terms, payment and refund requests, notes when a job ends or is cancelled, photos and other files, your name and business name, your business profile, and reviews and review notes. We call all of this "content."
1.2 Both sides of the marketplace.
They apply the same way to customers and to businesses. A business is also responsible for content its staff post on its account.
1.3 What the Platform is for.
Use the Platform only to find, arrange, and pay for work on a home.
SECTION 2. TREAT PEOPLE WITH RESPECT
2.1 No harassment or threats.
Do not threaten, intimidate, bully, or harass anyone, including after a job has gone badly. Do not keep contacting someone who has asked you to stop or has blocked you.
2.2 No hate or discrimination.
Do not use slurs or attack anyone based on race, color, religion, sex, sexual orientation, gender identity, national origin, disability, age, or familial status. A business may not discriminate because of any of these, whether in pricing, availability, quality of work, or otherwise.
2.3 No sexual content or advances.
Do not send sexual content, sexual comments, or romantic or sexual advances to anyone you meet through the Platform.
2.4 No spam.
Do not send the same message to many people, persistently message someone who has not answered, advertise unrelated products or services, or post requests or bids you do not mean.
SECTION 3. BE HONEST ABOUT THE WORK
3.1 Requests.
Describe the work you need as it is, in the category it belongs in, and include what a business would need to know to price it.
3.2 Bids and changes.
Say in your bid or add-on what work it covers. Bid only on work you can do, at a price you mean. Do not bid low to win the job and then raise the price for reasons you knew about or should have known about. When the work really does change, ask for the change through the app, say why, and wait for the customer's answer.
3.3 Who you are.
Use your own name, or your business's legal name. Do not pretend to be another person or business, or to hold a license, insurance, or qualification you do not have.
SECTION 4. KEEP CONTACT AND PAYMENT IN THE APP
4.1 Contact details.
A request, a bid, a review, and a name are read by people you have not chosen to share your details with, so none of them may include a phone number or an email address. In a conversation, you may share them once the job is hired and while it is open or a refund on it is being settled, or once either of you has shared contact details using the app's own buttons. Until then, use "Ask for their number" instead. The app refuses a phone number or email address typed anywhere it is not yet allowed.
4.2 Payment.
Payment for a job found on the Platform goes through the Platform, before and after the job is hired, except as the Customer Terms of Service and the Provider Agreement allow. Do not ask for or offer payment by cash, check, Venmo, Zelle, Cash App, PayPal, or any other way, and do not agree to move a job off the Platform to avoid fees. The Customer Terms and the Provider Agreement set out what happens when a job is taken off the Platform.
SECTION 5. NOTHING ILLEGAL OR UNSAFE
5.1 Illegal work.
Do not request, offer, or agree to work that is illegal, including work that requires a license the business does not hold, and do not ask anyone to skip a permit or inspection the law requires.
5.2 Illegal content.
Do not post anything that is illegal to post, and do not use the Platform to sell or arrange anything illegal. We report content to the authorities where the law requires us to.
5.3 Safety.
Do not encourage anyone to do something dangerous, and do not threaten anyone's safety or property.
SECTION 6. RESPECT PEOPLE'S PRIVACY
6.1 Other people's information.
Use what someone shares with you for a job, such as their address or phone number, only for that job. Do not post anyone's personal information, including in a review.
6.2 Homes and people.
What you see in someone's home stays private. Do not photograph people without their permission, or anything in a home that is not part of the job.
SECTION 7. REVIEWS ARE REAL AND FAIR
7.1 Real experiences.
Only a customer who hired a business for a job through the Platform can review it, and a review describes that customer's own experience of that job.
7.2 No paid or pressured reviews.
A business may not offer anything in return for a review, ask for a review only from customers it expects to be happy, write a review of itself, or pressure a customer to change or remove one. A customer may not threaten a bad review to get a discount or other benefit.
7.3 Fair comment.
An unfavorable review that is honest stays up. We remove a review note that breaks these Guidelines, such as one that contains personal information or a slur, but we do not remove a review because a business disagrees with it.
SECTION 8. PHOTOS AND FILES
8.1 Relevant and yours to share.
Upload only photos and files that relate to the job and that you have the right to share. Do not upload sexual, violent, or shocking images.
8.2 Intimate images shared without consent.
If an intimate image of you, or of someone you are authorized to act for, has been posted on the Platform without consent, you can ask us to remove it. You do not need an account. Use Report on the request, bid, or message it appears in and choose "It's offensive or unsafe," then "It's an intimate image of me shared without consent," or use the form at dudewheresmypro.com/take-it-down. Your request must include (a) your physical or electronic signature, such as your full name typed; (b) enough information for us to find the image, such as the job or message it appears in, or a description of it and where it is; (c) a short statement that you believe in good faith that the image was posted without the consent of the person shown, with any information that helps us; and (d) an email address where we can reach you.
When you report it from the item it appears in, we hide the photos and files on that item at once. Within 48 hours of receiving a valid request, we remove the image and make reasonable efforts to find and remove identical copies of it on the Platform, and we refuse the same file if anyone uploads it again. Unlike other reports, we do not keep a copy of the image, and we never ask you to send it. We email you when we receive your request and when we have decided it. We keep your request and what we did about it.
Posting an intimate image of someone without their consent breaks Section 2.3, and we may suspend or close the account that posted it. Knowingly making a false request is itself a breach of these Guidelines.
SECTION 9. HOW WE ENFORCE THESE GUIDELINES
9.1 Automatic screening.
The Platform checks content automatically as it is written. It refuses content that contains certain slurs or explicit terms, that names a common payment app, or that shares contact details where Section 4.1 does not allow them, and it tells you why so you can reword it. A statement in a dispute about whether a Provider came may name a payment app, and we review it when it does. A note you add to a report is read only by us, and the Platform never refuses or changes it because of what it says, but if the note names a payment app, we review the report promptly. Some other words and phrases, such as threats, are delivered as written but are sent to us to review. Automatic screening is a word list, not a judgment about you, and it makes mistakes in both directions.
9.2 Reports.
Anyone can report content they think breaks these Guidelines, as Section 10 describes. We review reports of threats or illegal content, reports whose note names a payment app, and content flagged by screening, promptly. Other reports are counted, and we review an account once several different people have reported it within a period we set. We may limit how many reports one account can make in a day.
9.3 What we may do.
Depending on what happened and what has happened before, we may do nothing, remove the content, reset a business name or a display name, warn the account, suspend it, or close it. When we warn you, remove your content, or suspend or close your account, we tell you which part of our guidelines, terms, or agreements we determined was broken, unless that isn't practical or lawful. A warning is shown in the app and on the website until you confirm you have read it, and we also email it to you. A suspension stops new work while it lasts. Closing an account for a breach is described in the Customer Terms and the Provider Agreement. None of these actions ends your obligations for work already agreed or payment already owed.
9.4 We do not see everything.
We do not read every message, and not acting on something is not approval of it.
SECTION 10. REPORTING AND BLOCKING
10.1 Reporting.
Use Report on the request, bid, message, profile, or review, and choose the reason that fits best. We keep a copy of the content as it read when you reported it, so it does not matter if it is later changed or deleted.
10.2 What you will hear.
We confirm that we received your report. We do not tell you what action we took about another person's account, because that is between us and them.
10.3 Blocking.
You can block someone to stop seeing their requests or bids and to stop them contacting you. Blocking cancels a hired job that has not started or been billed, as a cancellation by the person who blocks, so a customer who blocks may owe a cancellation fee. You cannot block someone while you have unfinished work together, such as a job under way, a bill waiting to be paid, an open refund, dispute, or chargeback, or a finished job that can still be billed.
10.4 Reporting in good faith.
Report only what you believe breaks these Guidelines. Reporting a business or a customer to harm them, rather than because of what they posted, is itself a breach.
SECTION 11. APPEALS
11.1 How to appeal.
If you think we removed your content, warned you, or suspended or closed your account by mistake, email accounts@dudewheresmypro.com within 30 days. Send it from the email address on your account, say what we did, and explain why you think it was wrong. A decision made automatically can also be appealed as our Privacy Policy describes.
11.2 What happens next.
We look at the decision again, and where we can, someone who did not make it does. We reply by email. If we agree we got it wrong, we lift the suspension or the warning, or put back the account. We may also put back content we removed, and we do where the law requires it, for example after a valid copyright counter-notice under the Customer Terms of Service.
SECTION 12. CHANGES TO THESE GUIDELINES
12.1 New versions.
We may update these Guidelines. We post the new version on this page with the date it takes effect, and when a change materially affects what you may do or post on the Platform, we tell you in the app or by email before it takes effect. We keep every version we have published, and you can ask for an earlier one by writing to accounts@dudewheresmypro.com.
12.2 Which version applies.
We judge content and conduct against the version in force when it was posted or happened.
